Newman University strives to provide a campus environment that is safe and secure for all students, faculty and staff. Your awareness of policy and procedure is considered essential to campus security. Newman University provides 24 hour, seven days a week uniform security. The officers assigned are licensed through the City of Wichita and are authorized to enforce laws and policies on University property. The Security Department complies with the reporting requirements of the Kansas Bureau of Investigation, has close working relations with the Wichita Police Department, and cooperates with all law enforcement agencies.
React - Rapid Emergency Action Checklist
The Rapid Emergency Action Checklist (REACT) is intended to provide an easy source of information on specific steps that should be taken for the safety of you, others and to protect property in the minutes following a sudden emergency event.
All crimes occurring on Newman University property should be reported to the Wichita Police Department and to campus Security. The victim of a crime on campus should first call 911 to make a serial numbered incident report with the police and, in an emergency situation, obtain police and/or other emergency services.
Newman University Security will respond to emergency situations on campus and calls for aid, and will offer assistance until other agencies arrive.
Campus crime victims are strongly encouraged to file a formal Incident Report with University Security. Such a report serves to document the incident, enabling the Security Department to become better apprised of the situation and more proactive in follow-up and prevention efforts.
PERSONAL COUNSELING: Confidential short-term personal counseling is available on a referral basis without charge for students who wish to discuss concerns about university, family or personal life. Call Ext. 2319 for a confidential referral.
To prepare students and staff for emergency situations, evacuation drills will be conducted in the residence halls. Refusal to evacuate during a drill will result in disciplinary action and/or charges. Each time the alarm goes off residents should consider it a real fire and evacuate immediately, complying with all Residence Life Staff instructions.
What is Title IX?
Title IX of the Education Amendments of 1972 protects people from discrimination based on sex in education programs or activities which receive Federal financial assistance. Title IX states that: "No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance."
Zero Tolerance Policy
Newman University strives to provide an educational environment that reflects its Catholic mission and identity, respects the dignity of every person, and honors both personal and institutional integrity. The university prohibits all forms of gender and sex-based discrimination, examples of which can include acts of sexual violence, sexual harassment, domestic violence, dating violence, and stalking. All members of the campus community are expected to live in a spirit of critical consciousness and conduct themselves in a manner that does not infringe upon the rights of others. Newman University believes in a zero-tolerance policy for gender-based misconduct and the need for its community members to walk as compassionate companions, embracing a climate characterized by right relationships among all individuals. When an allegation of misconduct is brought to the university’s attention and a respondent is found to have violated this policy, the university will take prompt corrective action and impose serious sanctions to reasonably ensure that such actions are never repeated.

ALCOHOL AND DRUG POLICY
A. GENERAL POLICY STATEMENT
1. The unlawful use of drugs and alcohol continues to be a serious problem. Research indicates that serious physical and psychological effects can result from the use of these substances. Newman University is committed to providing an environment supportive of work and study. Newman University also seeks to assure the health and well-being of all students, faculty and staff. Newman University prohibits the unlawful possession, use, distribution or sale of illicit drugs and alcohol by university students, employees, participants at university-sponsored activities and organizations, and visitors on Newman University property.
2. In compliance with the Drug-Free Workplace Act of 1988 and The Drug Free Schools and Communities Act Amendments of 1989, students and employees of the university are hereby notified that the unlawful manufacture, distribution, possession or use of controlled substances and alcohol are prohibited on university premises. Controlled substances range from “street” drugs to physician prescribed drugs.
3. While it recognizes its primary mission as being educational, the university is also aware of its need to act in a disciplinary manner should any student or employee be found in violation of the university’s policy concerning the possession, use, distribution or sale of drugs, alcohol or tobacco products.
4. The university considers any unlawful use of drugs unacceptable and incompatible with its educational mission. The sale, distribution, transfer or involvement with illegal drugs, or the misuse of alcohol or prescription drugs, cannot and will not be tolerated by Newman University. State and federal laws concerning the use, possession or sale of such substances are enforced on the university campus. It should further be noted that the university is not and cannot be considered a protector or sanctuary from these laws. Students and employees are reminded that there are heavy penalties including imprisonment for the possession or distribution of unlawful drugs. Beyond the legal implications, students and employees are encouraged to weigh the seriousness of potential loss of function that may come from ingesting these substances.
5. In order to maintain a drug free community, unannounced searches may periodically be conducted on campus. This could include, but is not limited to searches involving a K-9 unit.
B. ALCOHOLIC BEVERAGES
In terms of the university policies, the word “alcohol” includes all forms of beverages that contain alcohol including, but not limited to, what has previously been referred to as cereal malt beverages (3.2 beer). Alcoholic beverages of any kind are prohibited in students’ residence hall rooms, main lobby, corridors and floor lounges of the residence halls and outside the residence halls on the campus of Newman University. Exceptions to this policy are as follows:
1. Non-Student Events
Alcoholic beverages are allowed on campus or at university events, at some events whose primary audience is not students and where the consumption of alcoholic beverages has been approved by the Vice President of Finance and Administration. Alcohol request forms are available in the Office of Finance and Administration.
2. Student Events
Alcoholic beverages are allowed at special university events where underage students do constitute a significant portion of the population (i.e. Homecoming) only when the following conditions are met:
a. Approval of the Dean of Students, Associate Vice President of Academic Affairs, and the Vice President of Finance and Administration.
b. Compliance with guidelines established and approved by the Provost and Vice President for Academic Affairs.
3. Residences on Campus
a. Alcoholic beverages are allowed on campus in the residences of professional, live-in university staff members.
b. Fugate Hall residents are subject to the alcohol policy outlined in their contract and Residence Life Handbook.
4. Alcohol Violations
Alcohol violations at Newman University include, but are not limited to, the following:
a. Possession and/or consumption of alcohol on campus, regardless of the student’s age, in unapproved locations and settings
b. Hosting a party on campus involving alcohol
c. Being present where alcohol is found
d. Dispensing alcohol to minors
e. Public intoxication
f. Consuming alcohol while in the presence of a minor in Fugate Apartments
It is our hope that knowing what consequences exist will assist students in making positive decisions concerning their behavior. Our primary objective of assisting students in developing a greater sense of personal responsibility and maturity remains unchanged.
Sanctions for violations at Newman University include but are not limited to:
1. Monetary fines
2. Restitution hours
3. Successful completion of online Judicial Educator modules or other educational assignments
4. Mandated counseling sessions with a campus counselor
5. Placement on probationary status
6. Suspension from the university
7. Mandated completion of a drug and/or alcohol substance abuse counseling program at the student’s expense
8. Expulsion from the university
9. Parental consent forms/notification of parents
**Alcohol and drug violations are cumulative during a student’s academic career at Newman.**
C. ILLEGAL DRUGS AND CONTROLLED SUBSTANCES
1. The possession, consumption, distribution or use of drugs or controlled substances of any kind, unless as prescribed by a physician, is a violation of federal, state and local laws and of Newman University policy.
2. Students who violate the terms of this policy and/or engage in the sale, transfer or illegal use of narcotics and other unlawful drugs, including marijuana, may be reported to the appropriate law enforcement officials and will be subject to appropriate university sanctions which may include the following:
a. Placement on probationary status
b. Temporary suspension from classes and activities
c. Suspension for a semester from classes and activities
d. Expulsion from the Residence Halls
e. Expulsion from the University
f. Mandatory substance abuse counseling at the student’s expense
g. Other university sanctions
3. Any student involved in the distribution of illegal drugs or pharmaceutical drugs without a prescription from a university residence hall will be banned from the residence halls and will have their housing contract immediately terminated. In addition, they will be responsible for all other disciplinary sanctions, as assigned by the discipline process.
4. Students subjected to these sanctions will be afforded all due process rights to which they are entitled by law or under current policies affecting student discipline. In addition to the above sanctions, a student may be required to meet with a counselor. A student may be required to complete a drug or alcohol abuse education treatment program as a condition of continued enrollment or re-enrollment after suspension from the university. The cost of completing such a program will be the responsibility of the student.
D. TOBACCO PRODUCTS
According to a report by the National Commission on Drug-Free Schools (September 1990), “alcohol and tobacco are gateways to other, increasingly more harmful, drugs that can and often do have extremely negative consequences for the user, for the family of the user, and for the community at large, including schools and colleges. Some authorities claim that cigarettes probably kill more American consumers than all other drugs combined. The Commission believes that the nation’s illegal drug problems will not be eliminated until the gateway drugs – alcohol and tobacco – are dealt with more effectively.” Newman University strongly discourages the use of all tobacco products. Smoking and the use of other tobacco products (including chewing tobacco and electronic cigarettes) is prohibited in all campus buildings (including rooms and faculty offices) and is restricted to external environments only. Smoking is restricted to unenclosed, outdoor areas which are at least 10 feet from any building entrance.
E. COUNSELING AND EDUCATION
1. Newman University recognizes that the state of an individual’s health affects curricular and co-curricular performance and may affect growth potential. Within this context, the university is committed to educating students, faculty and staff about problems directly and indirectly associated with alcohol and other drugs. This commitment is demonstrated through workshops, classes and materials made available to the entire university community. This includes providing alcohol and other drug information for students and their family members in student orientation programs.
2. Newman University also provides consultation and referral assistance for students on a confidential basis through the office of Student Support Services. Training is provided for students to enable them to detect problems of alcohol abuse and other drug use and to refer persons with these problems to appropriate assistance.

•Short term professional personal counseling with a licensed counselor is available for students at no cost.
•Services are available for all currently enrolled students.
•All referrals and services are confidential.
•If needed, assistance with transportation can be provided.
MISSING STUDENT POLICY
All Newman University students living in on-campus housing will be requested to identify and provide confidential contact information to the Dean of Students or Director of Residence Life who will be responsible for the safe keeping of this information. Each student will be responsible for keeping the contact information updated and current. Upon University administration being informed of a student who has not been seen or heard from for a certain length of time and circumstances justify that an investigation of the student’s welfare or missing status should take place a Missing Persons Report will be made with the Wichita Police Department. A student living in on-campus housing will not be considered missing if they have provided information about their intended whereabouts or they are gone during a recognized University holiday and/or break.
If after 24 hours of making the initial police report it will be the responsibility of the Security Department to contact the Wichita Police Department to see if any contact has been made with the student. If not, the Security Director will contact the Dean of Students, and Director of Residence Life to see if any contact has been made and if not the Vice President/ Provost and the Associate Vice President of Academic Services will be notified of the situation. If, in fact, contact has been made with the student and his/her welfare is okay and no criminal activity took place it will be the responsibility of the Security Director to contact the Wichita Police Department and to inform them that the student has been located so that the Attempt to Locate can be cancelled.
If the student in question is under the age of eighteen (18) and not emancipated, the University is required to contact the missing student’s parent/s or guardian. If the student is emancipated or eighteen (18) years of age or older, the Dean of Students or Director of Residence Life if they haven’t already done so will contact the confidential contact person provided by the student prior to any police report being made.
